Welcome ! Ten years ago a bangladeshi High court banned fatwas against women sentenced to brutal punishment. Euphemism ? of course, is there enough in a word to speak about the expérience a tortured woman lives ? Some would say that image would be more relevant ? But i believe too much in words to exclude them from speaking about it... How far CAN words speak ? Clerics appealed this judgement. The suprême court answered and took a signifiant position now ! May 2011 ! Clerics consider that fawtas are intégral part of islamic religions practice. Islam is the main religion of the bangladedshi peuple practiced in a moderato form. The suprême court said that fatwas CAN be performed but with a limit : it cannot be enforced ? What does it mean ? CAN the absence of enfoncement be enforced ? What does it mean for a village woman to be sentenced by a fatwa may the torturius act it includes so far not be performed ? If one looks back at the past, fatwas performed sometime even lead to the death of the condemned woman. Even though the High court jugement had been given, ftwas kept on occuring these last years. What Will the suprême court jugement do ? What kind of enforcement does the suprême court jugement have ? Is there any one bringing the jugement to the sentenced woman in the future ? Will it reach her juges ? Will it reach the village population, the family with which she lives ? CAN we assume that she Will stand up and quote the suprême court how Will it be Heard ? What is legal enfoncement all about ? It seems here to be about the confrontation of ways of making world... It seems to be about representation necessarily diverse within people s mind... Some Will say that its better than nothing... Yes... Time is fleeting and Life is bumping on its sharp skin... 12/05/2011 civil appeal appelate division - suprême court of Bangladesh Case 593-94/01 P) Mr. Md. Nawab Ali, Mr. Md. Aftab Hossain R) Mr. A. K. M. Shahidul Huq, Mrs. Sufia Khatun Short Order: (i) Both the appeals are allowed in part by majority without any order as to costs. (ii) Fatwa on religious matters only may be given by the properly educated persons which may be accepted only voluntarily but any coercion or undue influence in any form is forbidden. (iii) But no person can pronounce fatwa which violates or affects the rights or reputation or dignity of any person which is covered by the law of the land. (iv) No punishment including physical violence and /or mental torture in any form, can be imposed or inflicted or any body in pursuance of fatwa. (v) The declaration of the High Court Division that the impugned fatwa is void and unauthorized, is maintained.
